# Bot Developer Terms

> Terms that govern use of the Cloak Bot SDK and bot tokens.

These Bot Developer Terms ("Terms") are a legal agreement between you and **Cloak Software LLC** ("Cloak", "we", "us") governing your use of the Cloak Bot SDK (`@cloak-software/bot-sdk`), bot tokens, and related developer tooling (together, the "Developer Materials").

By installing or using the Developer Materials, or by creating or using a Cloak bot token, you agree to these Terms. If you are using the Developer Materials on behalf of an organization, you represent that you have authority to bind that organization.

These Terms apply even if Cloak's general platform terms are not yet published. When platform terms are published at [cloak.chat](https://cloak.chat), they may apply to your use of the hosted Cloak service in addition to these Terms. Until then, these Terms are the contract for bot and SDK use.

## 1. Eligibility and accounts

You must be at least 13 years old. You must have a Cloak account in good standing to create bot tokens for Cloak's hosted service. You are responsible for everyone who uses bots or tokens under your account.

## 2. License to the SDK

The SDK is proprietary software owned by Cloak. Your rights to the SDK binary and source forms we distribute are stated in the `LICENSE` file shipped with `@cloak-software/bot-sdk`. In summary:

* You may install, use, and locally modify the SDK to build and run your own Cloak bots (including commercial bots).
* You may not redistribute, sublicense, or publish the SDK (or a thin wrapper of it) as a competing library or product.
* You retain ownership of your own bot application code.

## 3. Bot tokens and security

Bot tokens grant full end-to-end-encrypted membership in servers the bot joins. Treat them like passwords.

* Store tokens and keystores securely. Do not commit them to public repositories.
* Do not share tokens with third parties except as needed for your own hosting providers under contract.
* You are responsible for all activity performed with your tokens.
* Cloak may revoke or rotate tokens at any time for security, abuse, or Terms violations.

## 4. Acceptable use

You will not use the Developer Materials or any bot to:

* Violate law, or enable others to do so
* Spam, harass, or abuse Cloak users or servers
* Distribute malware or attempt to compromise devices or accounts
* Phish, impersonate Cloak, or impersonate other users or bots in a deceptive way
* Harvest personal information from messages or profiles your bot can access, except as needed to operate a legitimate bot feature the server expects, and never to sell or misuse that data
* Circumvent bans, rate limits, permission checks, or other technical protections
* Resell or broker access to Cloak itself
* Attack, overload, or disrupt Cloak's infrastructure or other users

Because Cloak bots decrypt message content inside your process, you must handle decrypted content carefully and only for the purposes of your bot as presented to server admins and users.

## 5. Self-hosted endpoints

The SDK may be pointed at a connection endpoint you operate yourself. Self-hosted use is allowed at your own risk. Cloak provides no support, SLA, or warranty for self-hosted stacks. These Terms still apply to the SDK itself. Conduct rules in Section 4 still apply if your bot interacts with Cloak-hosted users or servers.

## 6. Your bots and servers

You are solely responsible for your bots' behavior, including content they send and actions they take. Server owners control whether your bot may join and what permissions it receives. Cloak does not pre-screen bots.

## 7. Beta, changes, and availability

Cloak and the Developer Materials are under active development. Features, opcodes, APIs, and behavior may change, break, or be withdrawn without notice. Cloak does not guarantee uptime, delivery, or backward compatibility.

## 8. Intellectual property

Cloak owns Cloak, the SDK, and related trademarks. These Terms do not grant you rights to Cloak branding except as needed to truthfully state that your bot works with Cloak. Do not suggest Cloak created, endorses, or operates your bot unless we have agreed in writing.

## 9. Disclaimer of warranties

THE DEVELOPER MATERIALS AND CLOAK SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CLOAK DOES NOT WARRANT THAT THE SDK OR SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

## 10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOAK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE DEVELOPER MATERIALS.

CLOAK'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE DEVELOPER MATERIALS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CLOAK FOR CLOAK SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US \$100).

## 11. Indemnity

You will defend and indemnify Cloak Software LLC and its officers, directors, and agents against claims, damages, and expenses (including reasonable attorneys' fees) arising from your bots, your content, your misuse of decrypted data, or your breach of these Terms.

## 12. Suspension and termination

Cloak may suspend or terminate access to bot tokens, the SDK distribution, or related APIs if you breach these Terms, create risk, or as needed to protect the service. You may stop using the Developer Materials at any time. Sections that by nature should survive (including 2–4 and 8–14) survive termination.

## 13. Disputes

**Governing law.** These Terms are governed by the laws of the State of Nevada, excluding conflict-of-law rules.

**Informal resolution.** Before filing a claim, you agree to email [admin@cloak.chat](mailto:admin@cloak.chat) with a brief description of the dispute and to try to resolve it informally for 30 days.

**Arbitration.** If unresolved, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules. The seat of arbitration will be in Nevada unless you and Cloak agree otherwise. Judgment on the award may be entered in any court with jurisdiction.

**Small claims.** Either party may bring an individual action in small claims court for eligible claims.

**Class action waiver.** YOU AND CLOAK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

**Injunctive relief.** Either party may seek temporary injunctive or other equitable relief in court to protect intellectual property or confidential information without first completing informal resolution or arbitration.

## 14. General

These Terms are the entire agreement between you and Cloak regarding the Developer Materials, and supersede prior agreements on that subject. If a provision is unenforceable, the rest remains in effect. Cloak's failure to enforce a provision is not a waiver. You may not assign these Terms without Cloak's consent; Cloak may assign them in connection with a merger, acquisition, or sale of assets. Cloak may update these Terms by posting a revised version with a new "Last updated" date. Continued use after the effective date constitutes acceptance. For material changes, Cloak will also provide reasonable notice when practical (for example by email or a notice in developer documentation).
